Justice for All

And, once again - I am validated:

Man Framed for Child Pornography

The AP article (thus I won't quote out of it, lest I upset the AP folks), discusses the falsely accused, the stigmas, how it can happen - and that the justice system will, in the end - send the to hell. Why? Because this is America. This is the land of the Free. This is the land of fair and equal justice.

Not..... This is the land of justice for hire.

As the mother of one who has been through this and lost because he didn't have fifty thousand or more to fight this, knowing my son's innocence to be a fact, I can assure you - that the hatred and stigma out there forces innocents to fight and lose, or take pleas and spend their lives paying for it. But, once they've taken a plea - whether it was to protect the ones they love or not - even if science finally proves their innocence - the system won't ever give them that satisfaction and the public will hate them forever. That's the fallacy of the system. It takes nothing more than circumstantial evidence to send even the most sincere of innocent people to prison, and it takes a miracle to help them through it. I can guarantee you, because of the number of people that say, "burn that witch," because they, themselves, have not gone through this - this will keep happening.

There is no innocence project in Oregon to help them like there is in California. There is no accountability on the part of the DA's office. Oregon happens to be one of the few places left in the entire WORLD, that believes in grand jury indictments (no filtering of the grand jury members and permissible levels of presenting false information to them by the prosecution while the defense gets no say). If you don't believe this can happen, then you haven't learned enough in life yet and you're naive. And, for that, I fear for you. Guard everything - password everything - but know that even then, the police are allowed to lie, the prosecution is allowed to convict you without evidence that you were there, and it's just as easy to take a fall, as it is to set someone up to do it. Trust me - the several years that we've battled this situation has educated us to what we didn't know was possible. Like many of you, I would have said, several years ago, burn them; or there's more to it. Now I know. No one will listen because of the stigma. The governing authorities and courts of this state will not help, and innocent people sit in prison, and/or on offender lists, hated by their peers, unable to get their lives back in order, because our society is still full of superstitious witch hunters.

I can only pray to God, that He will continue to be there for our family, and the gentleman listed in the above referenced article - because right now - it will take an act of God Himself to bring truth to the justice system. Especially, for those with indigent defense - because while they may be great attorneys, they are overwhelmed with cases, underpaid for their work, the State will NOT provide for adequate defense experts (and that's a fact you can take to the bank), and they also have to overcome the stigma of a system prosecuting innocent people - abusing innocent children in the process. I pray that those of you who read this article, may have open hearts - may do the research - and before you pass any judgment - learn what you can. Go onto youtube and search for how these people hack wireless routers, see what these hackers do and see how they offer information to ANYONE, on how to hurt others. Watch the 5 to 10 minute videos on 'how to' do this terrible, and unforgivable act. Know that the Attorney General in Oregon, fought the RIAA and stopped subpoenas of computers where they couldn't 'prove,' a person was in front of a keyboard; but the AG's office won't support that same position for anyone else.

And, finally - remember this: YOUR computer IS your identity. You have your email, your contacts, your account information, your passwords, and everything else on there. Unless you search every file, every day - how would you know what was on there? Can you name every directory? Do you know if the picture you saved to the hard disk was what it appeared to be on the internet - because that, too - can be changed by sick pedophiles trying to hurt innocents. Look up defense attorney websites, defense forensic investigator websites and see for yourself, what the truth is. You may not have much 'worth,' stealing - but your identity is INVALUABLE. That's WHY there's antivirus/spyware/spam software; that's WHY airports tell you to guard your bag from someone else using it, and that's WHY you MUST be paranoid - because they will take the identities of innocents, not guilty people. They will harm those who believe they are exempt from it - because that's their challenge, and that's their mission. And, when it happens - when it appears to be that you're a witch - it will be to drown in the river to prove your innocence - welcome to the American Justice System, date: 2009.
 
You don't have to like your government to be a good American, you just have to love your country.

Misinformation and Memories

Yes - this is a loooonnnggg post, and it's not my normal political banter (although some is included), but I felt it was a topic that I wanted to share with you, because I believe in the importance of what I do here - offering perspective, possibility, ideas and reasoning - all so that you can formulate your own opinions, seek out new information and expand your own lives. I believe in the truth - no matter the consequences. Hopefully you enjoy (for anyone left who reads any of this! HAHAHAHAHA).... 

What is memory? What is the importance of memory? It’s certainly not the higher cognitive function that separates us from primates; for as studies show, they too, have memories. Some researchers interpret memory as that function which helps us to become more intelligent through a more structured, hierarchal methodology of information storage, allowing us to more quickly process the massive stream of input from our daily lives. Some believe memory to be nothing more than the necessary skill required to adapt to life and evolve through experience. Both are correct, and both are wrong. It is true, that what we are today, is a culmination of everything we’ve learned, both internally and externally. Some of us can retain information better than others, and some of us have trouble just trying to remember where we left our keys! Some of us find solace in reliving the events of our past, and some turn to chemical dependency to forget the past. Memories are both our doing and undoing. There’s an old analogy that we must keep in mind when considering what our memory means to us: you have to take the good with the bad. One does not exist without the other. For example, you would have no concept of sheer joy, if you did not understand absolute disappointment. Likewise, we must also remember that it’s not only about encompassing the entirety of our emotional state, but how we respond and react to those emotions that is a key definer in our lives. You could have no understanding of fear, if you did not understand its importance through experience. For example: If you had not felt the extreme warmth – or pain – of fire, you would not understand the fear of touching the stove. Finally, we must also remember that memory is not only governed from within, but without. It’s of no little consequence that we meet the people that we do in our lives. Every person, whether we want to acknowledge it or not, affects us in some manner. Whether it’s merely shaping our perception for the day (i.e. the inconsiderate driver who cuts us off and shortens our daily tolerance levels), or leaving a mark in our consciousness (such as the parent who has a phobia or tick that we too, develop), how we perceive them in our lives, no matter how large or small that may be, they do affect our very existence.

But, I’m afraid that it can become far more complex than just living a series of events – for each of us is unique – and so are our memories.

Memories are problematic. No matter how excellent your memory is, and regardless of how intelligent (or lack thereof), you may be, your perceptions will dramatically affect your memory. It’s no foreign concept to us that upon revisiting childhood residences, everything we “remember,” seems smaller. From the perspective of a ten year old, their closet may have seemed enormous at the time; while as an adult with a much larger wardrobe (albeit far fewer toys), we often find the available space to be frustratingly tiny. There are also other types of perception than just physical. There are perspectives based solely upon our feelings. For example, if we were in a fairly consistent state of feeling somewhat peaceful and happy, and a family member constantly went on tirades, we might have perceived that person to be “outrageous,” or overbearing and possibly even abusive. In retrospect, having grown up and joined the workforce in a blue collar position ourselves – under the command of an intolerable boss – we might be able to more easily understand that our parent was simply coming home, frustrated by the abuse they were taking and the constant state of fear they lived in, worrying about how they could feed their family, and simply venting their frustration and we were taking it personally. This very phenomenon is well documented in the psychological community.

Yet, it doesn’t end there. For what is a perception, if not a unique and individual interpretation of an event.

Not the facts.

What does this mean? This means that every one of us, at some point in time, are living with a “false,” memory. Perhaps it is nothing more than believing that you shouldn’t feed your child too much peanut butter and jelly because that’s all you received as a child and you grew to hate it, when in fact, you happened to have a minor allergy to peanut butter that went unchecked during your entire child hood and the ‘less than three times per month,’ pb&j that good ol’ mom put in your lunchbox stood out in your mind as a daily torment. False memories are a terrible problem for society. They involve psychological difficulties that have caused massive deterioration in the psyche of the whole of humanity. Worse, are the implantation of false memories, even by accident, stemming from the delusional attempt of psychologists to recover “repressed,” memories. This innocent, yet horrifically egregious act, has sent innocent men and women to prison, caused individuals to have mental breakdowns, torn apart families and even been the key force in suicide and murder. You don’t often hear these stories, because they are so outrageous, and so frightening - and sadly – without a reasonable and sound explanation, that the media intentionally avoids them. If you were told that 1 out of every 25 men in prison, convicted of raping their daughters 20 or 30 years ago were innocent and actually the victims of psychology’s feeble attempt at ‘recovering,’ repressed memories, you might be less inclined to seek psychological counseling, or view the inmates in a prison with the hatred and fear that the media so strives to encourage. In fact, you may even find fault with the justice system and demand your state legislature to start requiring absolute evidence in courtrooms. Of course, this would lead to a dismissal of more than 22% of EVERY case and be the cause for the release of tens of thousands of prisoners around the nation. So, the media feels it’s better NOT to tell you.

But, therein lies the social problem of memories – because lies, deceit, false perceptions, misleading information and incorrect interpretations from external sources will affect your memories, and thusly, your entire being. I can guarantee you that right now, [most of] you have a vivid memory of being told somewhere in your youth not to talk to strangers. It was repeated so often, and under such frightening circumstances (whether lived or implied), that the importance of this fact is burned into your psyche. So, why are children still the victims of psychologically deviant adults? Because, in more than 80% of all cases of extreme abuse: it is not a stranger – but a family member. While it’s important that we continue to teach our children the importance of not speaking to strangers, the misgivings we create for them, letting them believe in absolution, the security they will find in their own homes, has lead to a constant barrage of negative behavior toward unsuspecting young ones. Of course, that’s the ‘simplicity,’ of misperception and external input. The full complexity of this dilemma does not rear its ugly head until we reach adulthood. Recently, I found myself, for the third time, a minority in the perception of events which took place in my past. It was frustrating that I was outnumbered, because I was the oldest of three brothers, so why should I have any faith in their perception of the events and absolute certainty they have over how these events played out? I even have difficulty in accepting my own parental figure’s perception of these events, regardless of the correlation it has with my brothers’, for my perception is wildly different. And, then, something happened…

I began to question myself and see an entirely new memory.

The situation was this: I remember a pair of kittens that had been given to my family when I was just a child. I vividly remember one of the kittens was hit by a car. I even remember hearing about it at the home of my grandmother, believing in my mind that it was an accident by another member of the family (or so it was presumed at the time as that member of the family brought the dead animal in with them claiming they had found it at the edge of the driveway), and being told that as we did not have any validation of who struck the animal, we could not be certain of the truth and should not make speculations that would lead to unnecessary, hurt feelings. I can even vividly remember standing in my grandmother’s paved driveway, staring out at the edge of it and wondering where exactly it happened (in my mind, it was a mystery I wanted resolved for I felt very distraught at the animal’s passing). However, my family remembers the events in a completely different setting. They remember that we had moved out to a vineyard with a dirt road, when we first obtained the kittens. They remember the dead one being brought in by one of the Hispanic workers (or pointed out to them, at least) after it had been stuck (after having owned them only a short time). I don’t believe I was actually there when the kitten was brought into the house and we were informed of its death, as I was told about this, and have no mixed or confirmed memories either way. But, as I played out this event in my head, again and again, something strange happened. Now, when I remember back to looking out at the driveway to try and determine where and how the animal was killed, I see the unpaved road of the vineyard – not my grandmother’s house.

Wait a second – did that happen? Now I can clearly see BOTH memories, and my mind is in absolute turmoil. Which one is the correct one, for they both cannot be accurate? I know my brain has been attempting to resolve this, but as of yet, no such luck. On one hand, there is the absolute confirmation of my family members that their story is true and can be collaborated. On the other hand, I have my sound and vivid memory of this event; for it was a traumatic one in my mind and stands out. If they are correct – I am certifiably insane. Why? Because, it was by no external influence or other means that my mind resolved the memory to have taken place at the home of my grandmother. My psyche fabricated a memory on its own (or altered it, as the case may be); for whatever reason it decided to do so. But, why? What purpose did it serve to change the location? Did it ‘ease the pain?’ Or perhaps, was the event so obscure and unimportant that as I grew older, I simply forgot the details and my mind filled them in for me? Either way – if my family is correct – how many more memories of mine are wrong? How many memories of mine will I never be able to know the truth about simply because there is no one else to confirm the facts? Worried, I decided to see if I was alone in the world, to understand if the alteration of one’s memories by one’s own psyche was indeed, at all, unique. I’m not concerned about the memories which may be altered by a physical perception such as weight vs. height or size, but an alteration of an entire event based on an unknown and indeterminable factor.

I am not alone.

In fact, given my disability, I am in a worse position than every other person out there without a similar, neurological condition, to have a completely fabricated memory of my youth. In a research study published by John Merriman in Neurology Reviews, “Dreaming – An Altered State of Consciousness,” (2002), scientists had determined that through the more recent advances in research on narcolepsy and lucid dreaming, they were able to determine that the enhanced, emotional states of “wake” dreaming, could give way to false memories (see full research study for details). This is a phenomenon I am all too well aware of, for it’s the neurological condition with which I live. Oft times I must address members of my family, friends and colleagues and ask for confirmation on whether or not an event actually occurred. Without spending too much time detailing the science of lucid dreaming, I’ll shorten it to say that: distinguishing a lucid dream from the truth, can sometimes become a near impossible task – and that’s after 15 years of practice. Yet, I have never experienced a time during these states in which I completely relived an actual event that could give way to an alteration of the truth. And, yet, the altered memories I have are indeed, a very real problem that I must accept and deal with.

If we are the culmination of the events of our lives, then what are we when our memories are not what they seem? How do we begin to accept our own mortality – our own reality of existence – when it’s all a lie (or at least a portion of it – and what portion that is – we cannot know)?

In the article, Memory and the Misinformation Effect, (1997/2005), the author, Marica Sevelj, discusses the published accounts of the phenomenon of altered memories. This article, which has gone widely unnoticed or recognized in professional circles (to the best of my research), is perhaps one of the most profound and important statements on the cause of humanity’s current state of existence that can be found anywhere. Recent media personalities such as Glenn Beck have fought hard to bring to light the truth about our Founding fathers and some of the darker secrets of more recent Presidents whom we have apparently, ‘admired,’ as a nation, for the last 50 – 60 years. In fact, several radio personalities have begun to disclose their concerns over alterations by the government regarding books and historical “facts.” But, their recent revelations have not changed the fact that these alterations and modifications, falsifications of truth by the media, alterations of perception in our education and religion, have been occurring and have already affected us. What can we take from that? For starters, we can begin to understand why our nation – and even the world – has turned out the way it is today. I’m not trying to implicate that humanity is ‘bad,’ per se, just because our oceans are polluted to the point of near, absolute ecological destruction; our water table contains a myriad of poisons in it that have irreversibly altered our evolutional course; and we have bankrolled ourselves into a society of “technology-needy” people; I’m just saying that we are definitely at a point that is not as good as it could be.

But, is memory to blame?

If we perceive that our spending habits are good because the media enforces it (see previous blog on Capitalism vs. Free Enterprise), then perhaps, based on our perception, it is good because we have no reason to believe otherwise. But, if our spending habits and technology-needy society has reduced itself to a global, economic crisis and seems to be confused as to how it happened, pointing fingers in every direction and at every person they can find – then perhaps this altered perception – externally driven, is a serious problem. If we blindly have perceived justice to be well-established and run in an entirely highly moralistic fashion (whether through television’s influence or our own fear of questioning the system), and we feel justice is being well served, then perhaps it is. However, if there are innocent people sitting in prison; entire governmental agencies committing outrageous acts against the people and children (see previous blogs on DHS/CPS and Capitalism), and defending itself through the justice system and the fear mongering it enforces with threats of prison, then perhaps, things are much worse than they seem.

And, now I must ask the question about my own memory regarding the kitten: were my brothers’ memories influenced by a suggestion by our parent? Now, which one of these memories is accurate? How do I know? One of my parents can show documents legally filed by the other, validating facts which they themselves, had not realized to be true, and facts can begin to assert themselves accordingly. I can be shown documents I apparently created that I have no memory of creating, and facts can again, be worked out by the conscious and unconscious states of the mind and the truth be known. But, where there are no documents, no pictures and no facts – just like it would be in a court case with no ‘factual,’ evidence, only circumstantial evidence, we must either accept what we’re told as the truth, stick with our own version of the truth, or remain undecided. The trouble is – if we accept their version – then we have a neurological problem with our own memories and thusly, our very existence. If remain true to our own versions of the story, we will still have that lingering, small bit of doubt that will plague us constantly as we are still in contradiction with others. Yet, if we remain undecided, we have two memories – two possibilities in which both could be wrong – and the real difficulty in understanding our existence and how to interpret what we’re given on a daily basis, begins.

Look around you – go ahead – I’ll wait……. Seen enough? Now, remember what you saw: A computer, walls, paint, yourself, perhaps other co-workers or people you know? Perhaps you looked out a window at the sky, or maybe just the building next door that’s framed by your window. It’s both what you see, and what you didn’t see, that’s the problem. Think about the people around you, the ‘anxieties,’ developed, the economical conditions of our world and how we’re living. How can we perceive the truth about them if they are hiding their feelings? Think about the things you own and possess that affects your daily lives. That computer – wasn’t there 30 years ago. Your cell phone wasn’t there 20 years ago. The buildings and homes you see outside, or perhaps the skyline over an ecosystem that may appear to be thriving wildly but is in fact, severely hurting from the acts of humanity, are not what you grew up with, or at least, not what you were told about. Remember the Brontosaurus? The peaceful, loving herbivore from the Jurassic period we were taught about in school? Gone. No more. Oops – science spent 50 years of school text books telling us it was real and then, *poof* - it’s gone.

Poof – it’s gone? WTF? How can it be “gone?” First off – to us – it never existed, we simply take it on faith that it did. If the people who control what we read and see every day, who influence our lives on a minute by minute basis, can simply erase things overnight, then what else is gone? What else doesn’t exist that we don’t know once existed? Our children don’t know what a brontosaurus is, unless we’ve told them. And, their children will most certainly not know what it is. The dilemma is not necessarily the importance of the Brontosaurus itself (although the accuracy of science should be a factor we all take seriously), but rather, it is the point in which we determine what’s “important,” and what’s not. Is it important that there was a brontosaurus? Does it matter that it’s actually an Apatosaurus? While you may be telling yourself that something that lived that long ago is just not that important – remember – it is a memory you possess that was erased. Remember – that the people who shaped your lives, and are now shaping the lives of our children, mislead you. Maybe that Brontosaurus isn’t that “important,” but how much else have they “mislead,” you with – that is important? If people like Glenn Beck didn’t stand up and tell us the truth about what our most “beloved,” presidents really preached to us, would we know? Would we remember? And, yet – the information is right there in front of us. We have heard their speeches, and yet, we’ve heard nothing. I posted a blog back during Obama’s campaign that linked directly to his website, which he has now dramatically altered [of course], that detailed his intentions on health care reform and the public option. I posted links on his economic reform that HE, and his campaign crew, posted on the internet for all to see. These were statements on his intentions for America which he is now trying to implement and everyone is opposed to. People are claiming that he didn’t “turn out to be the President they expected.” Why? The information was right there in front of them. Some read it; some didn’t. Regardless of who read it, they still voted for him because they couldn’t see what was there even though they were looking right at it!

There is a belief that the civilizations of middle America that were first met by Christopher Columbus, could not see his boats approaching. It is believed by some, that because they could not comprehend or fathom the fact that things such ocean-bearing ships existed, in order to deal with it, their psyche blocked it out. There are those that say this is rubbish. And, yet, we have actual maps showing the world as flat, with water pouring off the edge into an empty abyss. At one point, the whole of humanity accepted the world was flat because they were told it was by the same Monarchy and leaders that abused their power over them. Until the last part of the 19th century when Freud began his career, so-called, ‘psychologists,’ believed in lobotomizing people as a means to cure insanity and criminal behavior! It was a legally accepted pretense! Until 2 years ago, a State in America – the land of freedom – still contained a clause that made it legal to kill certain religious groups!? The people accepted it, because their leaders – the people they trusted to be in charge – said it was okay. And, yet, have things changed? Are our memories repaired? Are we no longer lead down the primrose path of self-delusion stemming from the falsification of our lives? Have we overcome the obstacle of altered memories and found the resolutions of peace that will affirm our existence with a resounding, unquestioned tone of facts? Do you remember looking around? Do you need me to really answer that question for you? In fact, it’s better if you seek out the answer on your own – because my perception is not yours. My history is shrouded in confusion and doubt and I have a long way to go in working that out.

Just remember this – we cannot dwell on this topic. We cannot live in the constant state of doubt which leads down a darkened path, for I too, have done this. Questioning faith, reality and existence to the point I wasn’t paying enough attention to my life allowed dark forces to break in and destroy it. But, if they had not, I would not have seen the truth; I would not have seen them for who and what they really are. I would not have begun to understand how it is that six different people in my family have different memories, at different times, of the same event. I would not have begun to understand how to “live,” and truly survive in our culture, weaving my way through the dark waters of misinformation that has plagued us to this very day. What did happen to the kitten over 20 years ago? That is a mystery that may remain unresolved, but it's one issue I can live with, for I enjoyed him while we had him, and have learned to love the animals in my life now even more than before. Hopefully, what can come from all of this is: you will not have to be a victim before you understand the truth of what’s happening. Perhaps, as an external influence upon your life, I can pass on my experiences, and you can learn the truth for yourself. Just like the child who doesn’t have to actually get burned to understand that touching the stove is painful, accepting the truth on faith from those who would not lie to them, you too can avoid getting burned and begin to question the truth about your past. Was it so bad? Was it so terrible? Is what you’re being told the truth? Which of your perceptions on reality today are governed by your own mind, and which are the culmination of lies?  How much of your past should you question, and how much can you simply shrug off? Many people live in a very depressed state because they remember negative events from their past, and while those events may be of such severity that their depression is well-justified, perhaps the opportunity to understand that their memories are not 100% accurate, because no one’s memory is, can offer some relief. Perhaps, rather than accepting what we’re told in political and media-driven forums (including this one), we will begin to seek the truth for ourselves, accept that everything we read is only a perception or interpretation of an event, and use our own psyche to form the resolve. Then, we can truly begin to form the greatest resolution of all time – life.

An Empire revisited - freedom lost

Quite some time back I discussed America as an up and coming Empire - An Empire being:
 
1. The region over which Imperial Dominion is exercised,
2. A group of countries under a single authority (which, Great Britain, and America, both qualify as),
3. A monarchy with an Emperor as the head of state,
4. conglomerate, a group of diverse companies under common ownership and run as a singular entity
 
An Imperial Dominion - a supreme ruler over all nations. Look at what America is - is it a Republic? Well, a Republic is a conglomerate, but the people have influence over the government through some form of Democracy or similar political structure. I'm not really sure that America completely qualifies as a republic any longer, given the limitations on freedom, passing of laws without representation and misrepresentation in the passing of certain laws which place dominion and control on the people. Of course, as we are on the path to a Marxist Socialist way of life, the definition of an Empire becomes more clear for America. Actions in our economy such as "the New Deal," by Roosevelt, most certainly took us away from being a Republic and began instituting solid foundations in Imperial Dominion.
 
As I discussed in my last article, "The New Deal '2'," the investment of the government into overpricing is most certainly tearing our economy apart as it's replaying the events that helped lead up to the great depression. A loaf of bread that was $2 is now $100, and box cars that were $75,000, are now $2,000,000; and the government won't back those items at those inflated prices, or else the currency, it's "I.O.U.'s," would devalue the gold that backs it. If you read about what happened with Freddie Mae and Freddie Mac, GSE's that bought overpriced Mortgages/home loans (that the people couldn't repay, driving home prices through the roof), and how AIG created insurance policies to back these overinflated mortgages, you begin to see more and more of how the government, with a power/rule that far exceeds a standard "Republic," committed an act which helped contribute to the dramatic economic difficulty we're in now. The problem is, AIG is holding onto insurance policies that the government won't back. Amtrak's holding onto boxcars that the government won't back. But, because of their being in bed together, because of GSE's and special interest and Wall Street, the government creates bail outs and stimulus packages that do what? Bail out the government - NOT the people. Is that a Republic? Is that representing the interests of the people? Does that even INVOLVE the people, or were the people just pawns in this big, game? It's GSE's... bailing out GSE's, and in the process, gaining MORE control of those companies, such as AIG (as they already had Amtrak), and suddenly, the definition of an Empire as a conglomerate, run as a single business, begins to be made even MORE clear.
 
Roosevelt's "New Deal," and all of the sham government controls over things like "social security, housing and civil works," would crash if the government crashes. They are inflated as it is now, and as economists have warned, will become hyperinflated. The government won't back them. That's why, when you heard that AIG had to be saved to protect companies and GM had to be saved to protect jobs - it did NOTHING. the same jobs were all still lost. The same bonuses were all still given. The bailouts and the stimulus have nothing to do with protecting the people - only the GSE's - the government - and its special interests. If jobs are saved along the way, then great - but that's only a "secondary," to the main goal of government covering their own actions. See, if AIG failed, the banks would need to collect on the debts. Who do they go to? The same GSE's that purchased the overinflated mortgages in the first place ... Uncle Same (through Freddie Mae and Mac). But, Uncle Sam can't back the bank's demands without devaluing the gold. If the dollar's worth 10 pieces of gold instead of 1 - think about what that would mean to the rest of the world and their wanting to collect... we'd be in a world of hurt.
 
This has been seen in history where an Empire overspends. Julius Caesar was spending left and right, building his armies, catering to the poor (through entertainment, not actually "solving," their problems...) to make them "believe" he was cool, then turning on them. His power was becoming absolute and he was ruining the country. He had to be stopped. Hitler originally invested in a lot of programs that supported a lot of jobs, until he began internalizing his power to become an Emperor. He began spending on government only projects - increasing his military's strength, specialized weapons projects, funding internal government sources to be his personal regime to maintain absolute authority, and this got him in trouble with his fellow leaders and the people. Jobs declined, but the government got wealthier. He had to be stopped. The British Empire had stretched its arms out to the world and spent a lot of money to do it. In fact, in all its spending, it sold itself short. It soon began to lose hold of its colonies. In America, where the King of England was lavishing his own with monies, it created dissention and chaos, even with their neighbors, France. The point is - everywhere overspending has been an issue, the value of the economy and currency declined, nothing good came of it. This includes the Great Depression and America. The government helped march us there, and rather than march back out, they somehow convinced us to let them keep going.
 
Are we a Democracy? That's a question you have to answer for yourself. Are we free? I certainly hope you don't think that getting to print a few words on the internet is freedom- because I can assure you - even though another is typing these words for me, both they and I do so in fear of retribution from our government. Have you control in voting on how YOUR tax dollars are spent? A republic would. Do you have control in what laws are passed? A republic would. Do you have control of who's in the primaries for you to vote on in an election, or who gets to be president without the electoral college's special interference OR who the next supreme court justice would be? A democracy... would. This isn't even a representative democracy. People were angry about the AIG spending, but would the government take the hit for what they did and represent the people? Nope. They said, "Bad AIG, no more really, really big, personal bonuses for you - only little ones." Is that... representing what you wanted?
 
Your stimulus monies have gone mostly to law enforcement for the streets and justice for the courts and special interest for the government, while the jails and schools suffer. Is that what you voted on? I mean, after all, you know that when there's no money left, you'll have to join in on the rioting to get bread to feed your family, so it's good there's more law enforcement to stop you, right? Hmm....
 
Are you even getting a say so in the legalization of marijuana? HAHAHAHAHA - I don't care to comment on what I think about it - but we're talking about a very OLD and very SENSITIVE issue - and you get NO voice. Especially, if you're NOT for it, and it gets passed - did your 'elected official,' do what you elected them to do (or vice versa)?
 
A republic, this is not. Not anymore.
 
A capitalist country, this is not, not under the conglomeration of private business to government say so and control.
 
A democracy, this is not. Not with the voice of the people fading into the wind.
 
So, what are you left with? Do the math people. Not too many choices out there. There's socialism, and marxist socialism. There's communism, monarchy's and dictatorships. There's aristocracies (which America has been for a long time now) and fascism (which also defines America's political structure perfectly).
 
Sure - there are a few other choices. But, once you've passed by a republic and a democracy, and capitalism has declined - so has freedom. So, whatever your equation ends up with - freedom is not going to be a part of it anymore.

The New Deal "2" - Death of an economy

Okay, if you want more background on this, please read my last post: Economic Forecast Follow-up. Be forewarned, what I'm about to give you is not a "prediction," an "estimation," a "best-guess," or a "conspiracy." I can promise you, it is not paranoia or any personal agenda that prompts me to write this. The foundation of what I'm about to present to you is the title of this entire blog: When Governments Lie - the people suffer. And, it's true. When our elected officials no longer represent us, act on our behalf or care whether or not their actions are hurting the people, then the control spire which was there to make sure that our "Government," in the land of the free and home of the brave, is no longer functioning. The government is no longer of the people, by the people ....
 
or for the people.
 
The Democratic Party - the party in control of the White House, in control of the Presidency and in control of the Economy, under the leadership of President Obama, is taking a dangerous position that is counter-productive to our economy and our stability. I usually hate taking sides folks, but this time around, the actions from the Government and the media being lead by them cannot be attributed to any other source. I'm not saying the Republicans are the only right ones - because our party has not done its job in cleaning house when this is the PERFECT time to do so (because we don't have influence in Washington, we might as well spend this time getting our party straight). But, the Left is in control, and it is under the direct leadership of the Left, no bleed-through from any previous administration, which is misleading the people. How so?
 
Obama has been encouraging investments in the Stock Market, and under this article, perhaps you will take as much delight as I did in the first sentence: "It's official. Obama thinks you're an idiot." I'll let you read that article to fully understand all the little quirks of Obama's "invest in the stock market to prove to America we're doing okay" plan. But, I'd like to draw your attention to another point of the stock market known as GSE's (government sponsored enterprises). These are not new, and have been around since the early 1900's. However,  GSE's started out as a different purpose than what they are today. You should note the following: The government possesses warrants with 79.9% ownership in these companies that would allow them to walk in and take full control at any time. With more recent companies like Freddie Mac and the banking/mortgage institutions, the government has several TRILLION $$'s in assets on record. What are those assets? Our HOMES.  The GSE's include ownership of companies - and stocks in the capital market - including WALL STREET (ie. their ownership of ... oil stocks.... :).. cool, huh?). This was "supposedly" to help raise long-term funds. But, let me simplify this:
 
If you invest in Wall Street - and help raise that number - there's a good chance that you're going to be investing in the government (ie. AMTRACK - who -- don't forget - was given $18 million in stimulus funds, in Delaware, for NINE box cars to be renovated, and yet, it is OWNED and controlled by the government, NOT free enterprise...). Of course, if the government wants to encourage your spending, they can simply do something as simple as... oh wait... give stimulus monies to the GSE's that are reflected in the stocks and it makes the stock market go up! So.. wait a second... let's pull all this together...
 
Could it possibly be, that the "increases," in the stock market (which some of you may have been watching what I have), seem to occur in sync with the issue of stimulus monies (and/or spending of it)? Could it possibly be that consumer confidence in Wall street IS down, and Obama, is just trying to do what he said he would BEFORE the election, and back in February? That is, to convince the American People to invest more money into the stock market? So - what does this mean? Would the government really do this? Would they issue out "stimulus" monies that mostly protect only the government and its investments and create a "false" sense of security in the stock market to encourage you to invest knowing that you're really just helping fund the government more?
 
The answer you're looking for is YES. This is EXACTLY what they're doing. If the stock market fails, multitudes of the government fail - because they get some of their monies through the stock market. AIG and others failing - was NOT about the American people, it was about the GOVERNMENT. See, no one's been telling you this. They've all said (even me), let them fail - if they're private enterprise, then let capitalism work. And, while that's true, the government's been operating quietly in the background not telling you that it's their own backsides they're trying to cover!! This is a complex issue folks, and I wish I had the space to detail this ALL for you (if I had a radio talk show - I could do it - but I know that reading LONG blogs is difficult).
 
The point is this - they're lying about the stock market and the economy. They want people to invest, or else it's the government that could collapse, and all the bogus, money-scams they've been running with it! The lie will cause you to give up your hard earned money into stocks that they own 79.9% of - and can reclaim in FULL, during times of an "economic crisis," (hmm....), and you will lose everything. This is NOT the great depression we're heading towards. Oh no, that wouldn't be as bad as what we're heading toward. Back then, when stocks dropped, it took wheelbarrows full of money to buy a loaf of bread. But, you won't have wheelbarrows full, or loaves to buy, because the government's going to reclaim its ownership of your stocks, and your money, and it will shut down the borrowing capacity to farmers and agriculture who were growing the wheat that can no longer afford to do so. THAT is the real danger. THAT is the big collapse we are heading toward. I'm not an "economist," and I don't know all the "ins and outs," of financial trade. But, I do know this:
 
U.S. currency - whether paper or coin, is an I.O.U. It is an object whose value is based solely upon the ability of the signer of that I.O.U. to reimburse you for it. I buy bread from you - I don't give you anything of value, because I have nothing. I give you an I.O.U., and the point and purpose of the Federal Reserve System, the F.D.I.C. and others, who are ALL government run - NOT privately (I say this, because you might remember that Obama just broke the law and fired the inspector general - one of the "peoples'", controls over the government... so yes, be afraid, be very afraid), is so that you can take your I.O.U. note to the bank and get reimbursed. During the great depression, why then did it take a wheelbarrow full of money to buy a loaf of bread, did the gold that backs those I.O.U.'s disappear or its international value drop to zero? No -
 
People lost jobs, couldn't spend, and their BORROWING capacity was reduced to nil and repossessions occurred galore! The stock market crashed because banks were forcing collection on debt (remember, they're the ones backed by the gold - but for some reason, this didn't seem to matter?? oh yeah - PBS that aired that - sort of left that out... guess who owns PBS... yep - Uncle Sam). If you read Ohio's take on the cause, it's because stocks were sold for more than what they were worth (hmm.. didn't Uncle Sam's I.O.U. notes help dictate all of that?). What's the ultimate conclusion of all this: that when the government was causing the U.S. Dollar to no longer have the value it did (and yes - regardless of what you'll read in some places, the banks set that dollar standard, and they were taken over LONG ago by the government, and Uncle Sam is the one who pulled his backing of the currency), and people realized that selling an item for $1 no longer meant $1, but $0.20 cents. Now bread was worth a wheelbarrow full of money. The gold's still there, but the value of the dollar dropped because those governing it wouldn't back it up at the same level anymore. And Hoover, the President in charge in 1929, said: We don't believe in helping the individual people. Sorta' sounds like... the whole thing was the fault of a selfish/capitalist government.. but maybe I'm just guessing here...
 
The lie - and how it hurts us? Back to my blog on the $18 million that saved 9 box cars for renovation... think about this... a new box car is worth: $75,000 max, and that's with a lot of the amenities. Just like buying a loaf of bread for $100 in 1929, we're buying a $75,000 box car with $2 million dollars. See the correlation? Understand how the lie is beginning to undermine this economy? No - it's not greed that will be spawned (oohh.. my box car's worth $2 mil), because the government OWNS Amtrak. It's a failure for the stock market, because the stocks the government owns are getting undermined, and the issuance of tens of trillions of dollars that are bottoming out our economy. Who cares if it's going to take 50 years just to pay back what the government spends in 2009 alone? That's ASSUMING the dollar's value goes back up! We need to be concerned about abuses with the stimulus money, falsely reporting to people that they should be investing in the stock market, "or companies will fail," and begin understanding that the lie will cause our stock investments to bottom out and crash our economy - again! Buying stocks in Amtrak... well... you just bought $18 million dollars in box cars, that MAY be worth.. AT BEST... $900,000. Remember the 1929 crash? Stocks being sold for more than what they were worth? The government saying - hey - we're not gonna' back your stock, we can't get more than $900,000 for those box cars in international trade and we MOST CERTAINLY, can't devalue our gold! The banks saying, um - you need to give us money now, because Uncle Sam's pulling his value out of the dollar?
 
If you can see the writing on the wall.. or even if you can't.. you need to read the Top 10 New Deal arrangements made by Franklin Roosevelt. What you're going to see is that we did NOT fix the problem. We didn't even band-aid it. The government reclaimed control of those GSE's I mentioned in the last article - and the results are what you see today. What was broken, got worse. In 1929, they LET the people and the businesses fail because there was NO way to bail them out. What the New Deal REALLY did - was to make sure that Uncle Sam doesn't take as much of a hit if it happens again (yes, I know, there were a couple of good things in it, too - but not enough).
 
The next, "New Deal," is upon us - and it will HAVE to be even MORE restrictive than last time and require an even GREATER failure for the people than last time. Are you ready? I'm not...

Economic Forecast Follow-up

Folks, a short while ago I posted a blog on: How not to read an economic forecast. Without having "all" the details or being an "insider," but being someone who follows the NEWS and pays close attention to what the media and government is feeding us, I boldly stated that the economic forecasters were either lying to us, or were just downright wrong in telling us retail was up because there were higher, 1st quarter earnings. For those who read it, you may remember that I stated that companies like Toyota, would definately report higher, 1st quarter earnings without GM dealerships to compete with, and stores like Walmart would report higher 1st quarter earnings with the littler, mom and pop stores having been driven out of business.
 
The brief report at Newsalert stated that on June 4th, Walmart was no longer going to report its monthly earnings because it "knew" that it was causing the economic forecasters to have an incorrect view of consumer spending behavior (and good for Walmart - maybe letting China own it was the best thing that could happen for that store!). What happened? The economic forecasters showed a dramatically sharp "drop" in retail spending from consumers (I believe the number was 24%+/-) from their previous forecast, when Walmart's individual stores were included. TWENTY FOUR percent is a HUGE number. Walmart accounts for nearly 15% of the U.S. retail economy with over 4000 stores! But, let's also consider that Best Buy has over 1,000 stores, and Home Depot has nearly 2,000 stores! The list goes on - and please check these numbers for yourself as I don't have an "economic" analyst to confirm them for me, but I know they're pretty close. What does that mean? It means - I was right. What I was telling you about the economic forecasters painting a false picture was dead on the money. People, please understand, I'm NOT boasting! In fact, it would be better if I WAS wrong. I would be much happier, because that would mean things WERE getting better - but they're NOT!
 
It was reported that Oregon's $175 million dollars in stimulus monies saved approximately 3,000 jobs. Set aside more recent reports that the so-called, "saved jobs," reports from the stimulus fundings are grotesquely over-exaggerated, because those 3,000 jobs equate to salaries of more than $58,300 PER PERSON!! The average income in Oregon in 2007 was $38,000+/-. It has NOT changed much in two years (especially with layoffs and a bad economy). Currently, the unemployment rate state-wide is 12.5%, or about 250,000 people!! What does all that mean? It means that the average person in Oregon, you know, the common workers, the little people like me (and maybe even you), are not seeing their jobs saved. The people who make this economy run - working in retail, fast food, gas, factories, production lines, and the "pleasures" of life that the wealthy community's money is supposed to give them access to - are not being helped by the stimulus package. What it also means, is that in order to save everyone's jobs, it would take $14 BILLION dollars. Unfortunately, the jobs that were "saved" were all government funded - ie. direct employment through the government or contracted labor to privately owned companies. So, the stimulus package, in the end, even if we received that $14 billion dollars, couldn't actually save everyone (oh yeah - this was the most RECENT stimulus package - you don't wanna know what we did with the rest.. hee heee hee).
 
Folks, I was right on with my concerns about economic forecasters by a government bought media (for those of you who read the TownHall magazine and know about the government's control over the media that I've been crying out loud about for a LONG time), and you can trust me when I tell you that this broadcasting of the "jobs" being saved by the stimulus money is B.S.!! And, like it or not, I can point the finger directly at the left - because they're in charge right now - so they get to bear this shame, not any "past" administration. Under President Obama, the media is providing FALSE numbers that are meant to stimulate "hope," and try desperately to save the stock market by encouraging MORE spending. The Democrats are committing one of the MOST DANGEROUS acts in this country's history - and I'll tell you how in the next post; but in the meantime, now you know just how bogus ALL of this "economic" forecasting and these numbers really are. You've been given sufficient knowledge know with which to head out into the world.

Sleep Disorder - Naroclepsy - When the Justice System won't "Wake up"

So, you were tired, picked up the kids, got home from the office, set down your keys and have no idea where they are, huh? You went shopping because you needed something healthy for dinner, but it was a long day at the office, and when you got home, you put everything away, collapsed on the couch, turned on the television and sometime later passed out. When you woke up, you couldn't exactly remember everything you did, what you did, where you went, what you said and now - you can't find the dinner you purchased?? Or - even better, you left it out and it's dethawed, or you shoved it in the freezer in the bag you bought it in, lazily, and just shrugged off the fact that you did something extremely unusual for yourself, knowing you were just 'tired.'
 
But - if you're not sure what you did on your way home and you can't remember everything you said, where you went or even recall, in any detail, the trip home - how do you know you didn't run a red light, speed, say something that's going to get you in trouble, went somewhere you didn't mean to go or worse? Imagine living like this everyday of your life and depending heavily upon medication to counter it. Imagine waking up one day and finding yourself being accosted by the authorities because you just shoplifted, made a threat on someone's life or worse - got into a car accident? Before you read on - try to imagine every minute of your most tired day these last two weeks - try to remember setting down a pen or pencil right in front of you and suddenly not being able to find it, or going to do a task and suddenly realizing you forgot what you were doing. If you can remember this - at any time in your life - you're about to understand what 1 minute in the life of a narcoleptic is like, and what that means legally - and you should be very worried.
What was once considered a rare disorder is now a world-wide phenomenon known as: Narcolepsy. It is one of the many sleep disorders that affects an estimated 3 million people around the world. In America, it is estimated that over 200,000 individuals suffer from this disorder, but only 50,000 are diagnosed. Even rarer on this list are those narcoleptics who suffer from the many side effects such as cataplexy, hallucinations, sleep paralysis and the now infamous: automatic behavior. Automatic behaviors are cataloged as a parasomnia. We all have them and we have all experienced them at one time or another. Examples include: Driving home and not even realizing how you got there, being thoroughly exhausted and putting things away then finding them in the strangest places without any idea how they got there. This type of behavior is common to extreme exhaustion, a condition which narcoleptics face on an hour by hour, minute by minute basis. Narcoleptics have been misdiagnosed since they have existed. Due to the strange behaviors of hallucinations and 'voices,' that come with a severe lack of REM sleep (and if you don't understand, then imagine this: the possibility of schizophrenia being misdiagnosed as narcolepsy and treated with frontal lobotomies through the middle to late 1800's is at least 75%!!! That's a lot of innocent, dead people); the depression and anxiety from missed sleep; the social anxiety from seizure conditions; the esteem issues from rapid weight changes and so on have caused narcoleptics to work as hard as they can over the years to stay under the radar and avoid prosecution from doctors and even their own families.
 
It is common for people to mistake narcolepsy as a variety of other symptoms: drug use, alcohol abuse, manic behaviors and more. And, more often than not, narcoleptics go through the gamut of testing for every other disorder in the book until a doctor finally recognizes the totality of behaviors and refers them to a sleep specialist. The truth is: narcolepsy cannot be faked. It is easily tested and diagnosed, but it is still rare enough, that it is not - or in the past - has not been the first symptom on doctors' lists. But, in the past several years, narcolepsy and other sleep disorders (such as sleep walking), have not only hit the radar, but have appeared in news articles almost on a monthly basis. The truth is, what is really appearing in these news articles are the 'parasomnias' related to sleep disorders such as sleepsex, sleepmurder, and most recently, sleep emailing.
 
The fact is: any behavior that can be conducted awake, can be conducted asleep - and it is NOT limited to autonomous behaviors (redundant, simple behaviors such as setting down keys or brushing of one's teeth). Sadly, these behaviors are also not always seen as autonomous because they are complex in nature. An individual in Canada by the name of Lamb, murdered his mother and attempted to murder his father and woke up some time later covered in blood and immediately turned himself in with no knowledge of what he had done. This is NOT unusual. In fact, a search through case files, state by state, will reveal that thousands of individuals, nation-wide, have gone to the police after finding themselves in a comprimising situation, been caught at the scene of the crime with no recollection of what they had done or were later caught because they tried to clear the evidence having woken up to the frightening scene of murder, unaware of how or why they were there. This has gone on since the day the United States of America was conceived - AND EARLIER. The problem: only in the last ten years have 'sleep disorder' centers been springing up. And, only in the last 5 years have they begun to appear like wildfire. Almost every major hospital and University in America now has a sleep-disorders center, or a neurological specialist who focuses on sleep disorders. Picture 20 years ago - not a single sleep disorders center of any reknown or knowledge or fame and over 85% of all neurologists untrained and unknowledgeable in sleep disorders.
 
In fact, in the 60's, individuals with sleep disorders were sent to institutions for the insane where they were examined, poked and prodded and eventually diagnosed with the proper disorder after years of analysis. Did these individuals get out? Go look up the "real" records and find out that most, did not. The epidemic of mistreatment of sleep disorders is even more widespread than the mentally/physically handicapped or the elderly. Fortunately, only 40 years later, teenagers and children who develop this disorder are no longer berated and abused by their parents (a common act that still occurs, but not as severe as it used to), but are taken to doctors and properly diagnosed. Adults still suffer from losing jobs and the ADA has made NO leway in requiring workplace accommodations for any sleep disorder, including narcolepsy. Narcoleptics can include doctors, lawyers, police, judges (yes - this has come up - a LOT - in the last ten years), and other people who are trying to be functional, tax-paying members of society. However, they still find themselves in divorce, losing their families, their jobs, their dignities and their lives. But - it gets worse.
 
The changes in technology have certainly challenged the court systems over the last ten years and the laws are so far behind that the level of ignorance in court rooms and amongst judges, police, jurors, prosecutors and the rest of society is so large, that more crime occurs than not and there are an estimated 25% of all people in prison for computer related crimes who are innocent. Unfortunately, unlike DNA that has been exonerated prisoners at an astonishing rate, computers don't always come with such clear and concise footprints. Contrary to the U.S. Supreme Court's decision that "It is better to let 10 guilty men go free than wronly imprison 1 innocent person," our paranoid society has done just the opposite, and without anything more than 'circumstantial' evidence, people are going to prison for life under the protest of their innocence, or pleading not guilty and taking plea bargains, losing their families, friends and livelihoods. But, even more challenging for the courts is the ever-evolving fields of psychology and neurology.
 
Neither of these are an exact science, and on a fluctuating basis either condemn people or set them free. There is no clear precedent, and what has been discovered today might be rediagnosed and rediscovered 20 years from now. Unfortunately, people with sleep disorders don't have 20 years from now. They are facing courtrooms on an alarmingly increasing basis. From sleep-rape to sleep-murder, epileptics, sleepwalkers, and others with parasomnias are finding themselves under scrutiny for 'mens rea': criminal intent. Did they intend to do the crime? Some might justify that an unconscious act is an obviously intentional one. Some might say that there is no such thing. But, as I stated earlier, these disorders are clearly identifiable, and don't think that anyone can just 'fake' their way through it. In fact - if someone tries, good luck. They can be connected to machines that will discover the truth. So, how do you tell if someone is acting intentionally because they are unconscious and it's their 'unconscious,' desire? Well, given that blanket determination and Freud's theory regarding the oedipal complex - we're ALL in danger! Eventually, we'll kill our fathers, and try to rape our mothers. But, how many of you who can remember your dreams can say that you've NEVER had a nightmare?
 
What if you think someone's trying to kill you and in defense, you automatically fight back? Have you never had a dream based on sex or violence ever? If not - I would dare say that either 1) You're not human, or 2) You're lying, or 3) You have no memory of it - and would be in even MORE danger than those who can at least recall some of their dreams. Now we come to emailing. This phenomenon is not new either (although it was recently and incorrectly reported by ABC that it is). Michelle Morandin, in March 2005, performed an analysis on Narcolepsy and automatic behavior and discovered to what extremely complicated extent automatic behaviors can occur. In fact, in the 60's, there is evidence of narcoleptics writing detailed letters and performing detailed tasks that they have no recollection of. Some of these were considered "incomplete," because they were not done without some level of intereference from being 'asleep,' while many, many others were considered 'complete,' because they were tasks performed very well and without any indication of the individual being asleep. This includes conversations, writing letters, walking around, driving, working and much, much more. But, on almost every occassion, something would be done or said, that while done functionally, was unusual for that person's personality.
 
For example, they may have made outrageously crude and cruel comments, argued or acted loving and sexual. At work, they may have mixed up formulas or patterns and functionally completed the 'wrong' task. They may have driven perfectly fine getting home, but at unsual speeds or with unsual driving patterns. How does this bode for the sleep disorders folks legally? Not well at all. A review of the NHTSA manual for visual recognition of driving under the influence, every last indicator is identical to an individual who has fallen asleep. While still dangerous, it is currently not a crime - but it will be treated as one. Shoplifting, even while on camera being asleep - is still illegal (even if the individual has the money and offers to pay or return an item for which they had no need, such as dog food for someone who owns no animals!!). But, what about sleep emailing or surfing the internet? Now the real trouble starts - two areas of law, technology and psychology, that are so severely incapable of keeping up with the curve, that the laws being relied upon for set precendences are completely inapplicable.
 
What if I send an email to someone claiming I want to kill them or I want to die? If I did it while asleep - I could have been dreaming. I could have had the television on at the same time and was being severely influenced by these matters. Worse, I would have no recollection of doing it, no reason to go look it up to see if I sent it (because I don't remember it), and no reason to believe that I would do that - challenging my own sanity!! But, in today's day and age, cyberhacking, viruses, pop-ups of an illicit nature and other such elements have become so commonplace, that it is an accepted given and the antivirus, antiphishing, anti-this and that industries have soared like eagles. What about this? How would someone who was surfing the internet, and passed out, but continued on surfing unconsciously, would they be able to handle pop-ups or redirects? Would they know where they're surfing or what they were doing? Would they know what they were doing during an ATM transaction or when working on a cash register?
 
One might argue that individuals with parasomnias shouldn't drive - but should anyone who is tired, drive? Should we take away everyone's license or install a device in every car to determine if someone is tired? Don't we have ENOUGH laws already? If the individuals can be on controlled medication, during the daytime, then they should have the same rights as everyone else. However, if anyone is disabled, such as a sleepwalkers, they make provisions to help them from walking at night. The same provisions could be made for others suffering from parasomnias as soon as the government is willing to recognize their disorder and begin to offer assistance. In the meantime -
 
If someone is impoverished and starving, and they steal bread: then they knowingly steal - there is a moralistic question, but the law is clear.
If someone is asleep and disabled with parasomnias out of their control, and they commit a crime: then they did NOT knowingly do anything wrong and may have no recollection of it. There is no question of innocence, only of whether or not they need added help to keep from doing the same act or ADA allowances to assist in their lives, but the law is NOT clear.
 
-Would you put someone who is a sleepwalker in prison for trying to commit suicide because they walked out a second story window? The law says you have to. Some might think it's hard to believe that would happen because they don't understand the disorder - but because the scientists have finally determined, after thousands of years of this disorder existing, that it 'exists,' the courts accept the lack of mens rea argument. Would you put a mentally handicapped person in prison because they saw a candybar they wanted and took it, not understanding that it was wrong? What about a child? We don't punish the disabled. America was founded by misfits of society seeking freedom from persecution because they believed and acted differently than society expected of its usual groups. How is this different for the disabled?
 
The laws, however, are slow to recognize parasomnias and even slower to keep up with technology. Nobody wants to create a loophole for criminals - period. But, ask yourself this: if you were to wake up one day with a sleep disorder such as narcolepsy (and yes - it really does happen that way - you wake up one day with it), and a criminal were to see you had it and knew that the laws were not yet up to speed on the topic, wouldn't we be creating a loophole by allowing them to falsely incriminate the innocent? It happens EVERY day! Mentally handicapped, chidlren, elderly, epileptics and so on are accused of things they did not do, and it allows criminals to get away with crimes. It makes us better understand why the Supreme Court wanted to keep innocent people out of prison: because if we don't, the guilty ones are left wandering free and are encouraged to continue falsely incriminating the innocent.
 
If you've read this whole article, and you think it's time that the law, "wakes up," then write to your Senators and your Congressmen - tell them that this cannot continue. Sorry that the courts are overwhelmed - but maybe if they quit making up new laws, without voter input, on a daily basis, to control every facet of our lives, the courts won't be overwhelmed. Quit wasting tax payer money for cops to perform road-side speed traps that cost us $60,000 per year and make only 1 tenth of that back in fines, and then if jail occurs, cost us even more - and work on 'REAL' crimes. Quit allowing the prosecutors of this fine country prosecute cases based SOLELY on circumstantial evidence? To do so - REALLY undermines the principals of justice. Require them to NOT force blanket laws with little applicability or pass judgments on presumptions of guilt versus facts of guilt, especially when dealing with disabled people such as sleepwalkers, narcoleptics and others, until they can get caught up and be rewritten, under the scientifically provable facts associated with sleep disorders (that can't be faked), to develop programs so that we don't falsely incriminate people.
 
This ISN'T the 1800's. We do NOT lobotomize people anymore!! At least - we're not supposed to. We are supposed to be a civilized society that seeks to help those who suffer from disorders and disabilities. A society that seeks to keep them productive members of our society and make use of their skills so that we can all work together. The scales of justice cannot be weighed down with gold bars on the prosecution's side merely because the government has the money to prosecute but the innocent are disabled and can barely afford their medication!!
 
Justice is blind - but it shouldn't be ignorant. It's time to wake up. And, only - with YOUR written input, your courage and your compassion, will this country change - yes - 1 person at a time - it has to start somewhere. I've started here - what will you do next?
